Ruling party MP Hisaan Hussein has made a submission to amend article 124 of the Penal Code to make “hate speech” a criminal offence in the Maldives. Under the amendment, an additional clause would be added to the article to make accusations of blasphemy a crime.
Under this law, accusing an individual of conducting themselves against the tenets of Islam will be punishable by a prison sentence of 1 month 6 days to 1 year. This would include creating hatred and prejudice towards a person based on their Islamic faith.
It would also make accusing individuals of blasphemy a criminal offence with a sentence of up to 2 years in prison. Encouraging and participating in calls for violence against individuals and accusing them of blasphemy would also carry the same sentence.
In addition to this, prejudice against a person based on their race and color and engaging or supporting violence against them would also carry a prison sentence where death due to bodily harm caused would result in a prison sentence of 25 years. Kidnapping, threatening and causing bodily harm with accusations of blasphemy would result in a maximum sentence of 15 years.
While the initial reading of this amendment has been criticized by the conservative public as a tool to tolerate blasphemy and secularism in the Maldives, ruling party members state that it is a necessary tool to combat against radicalism and extremism in the Maldives.
