Legal representatives from Save the Dream Pvt Ltd has submitted a complaint against the High Court bench of judges in the controversial case surrounding the annulment of the sublease agreement on the Rihiveli island.
Save the Dream Pvt Ltd is the French operator which had been operating the “Rihiveli the Dream” resort island under a sublease agreement with the Mahaal Tours Pvt Ltd. However, the agreement was promptly annulled forcing the Save the Dream Pvt Ltd to evict the island. However, on 18th October headlines were made after it was revealed that Mahaal Tours Pvt Ltd was subleasing the island to BeachX Pvt Ltd and reopening the island on the 15th of November 2021.
According to the legal representatives of Save the Dream Pvt Ltd, they had submitted and registered an appeal case at the High Court of Maldives on 13th September 2021. They stated that a hearing was scheduled for 26th and 28th of September 2021 but both were cancelled by the High Court of Maldives.
On 4th October 2021 a hearing was held on postponing the implementation of the verdict by the Civil Court pending appeal case but a settlement was not reached by both sides. Similar discussions were made on 11th October 2021 as well but no conclusive decisions or verdicts were made.
The legal representatives of Save the Dream Pvt Ltd submitted a letter on the very same day appealing the High Court to expedite the hearings due to allegations that the defendants were making preparations to reopen the Island with a different operator while the appeal case was on going.
According to them, North Fuvahmulak Constituency MP Mohamed Rasheed’s BEACHX Pvt Ltd had registered the business name “Rihiveli Resort Maldives” on the 5th of October.
An additional letter was sent on 17th October 2021 appealing to once again expedite the case hearing in light of the defendants alleged plans to reopen the resort island amidst the appeal hearing.
They further stated that due to the fact that announcements have been made on reopening the island on 15th November 2021 with the express consent of the defendants, they believe that a remedy is required for the case prior to this date. The legal representatives of Save the Dream Pvt Ltd further stated that due to the fact that they the High Court Judges are being unresponsive after repeated appeals to expedite the time sensitive case, they request to submit a complaint to the Judicial Service Commission against the Judges presiding over the case.
According to sources close to the case benches of three Judges currently preside over the case which includes Judge Hassan Shafeeu, Judge Hussein Mazeed and Judge Ali Sameer.
